Small Claims Courtup to R20,000
In South Africa, the Small Claims Court hears civil disputes up to R20,000 with no lawyers allowed on either side and no filing fee. You must first send a written letter of demand giving the other party 14 days to respond before the clerk of the court will issue a summons.
For larger matters, the Magistrates' Court hears claims up to R400,000. Consumers can complain free of charge to the National Consumer Commission or the relevant ombud. Legal Aid South Africa serves those below a means test.
